COMPLETE PERMIT APPLICATION AND REQUIREMENTS

  • All plans must be released for construction, signed and sealed by a Georgia registered architect or engineer on all pages (as appropriate).
  • All buildings described in these plans shall be designed in compliance with the current applicable codes along with revisions and amendments.
  • Ten (10) separate sets of civil and landscape plans including:
  • All parking, including parking decks.

SITE (partial) PERMIT SUBMISSION REQUIREMENTS

  • All civil plans must be released for construction, singed and sealed by a Georgia registered architect or engineer on all pages (as appropriate).
  • All buildings described in these plans shall be designed in compliance with the current applicable codes along with revisions and amendments.
  • Ten (10) separate sets of civil and landscape plans including:

                o All parking, including parking decks.

  • Two (2) copies of hydrology study
  • Two (2) copies of any pertinent ordinances (rezoning), special use permits, special administrative permits, variances or other documents relating to zoning approval, if applicable.
  • Three (3) separate copies of plans showing water service with backflow prevention at meter

  • Five (5) separate sets of either final architectural plans or preliminary architectural plans

Additional Site (Partial) Permit Submission Requirements

  • Preliminary architectural plans are required for information to evaluate zoning conditions, impact fees and other matters and do not have to be sealed.
  • Preliminary architectural plans must include (at a minimum) 
         o  Complete floor plans with dimensions
         o  Elevations 
         o  Building occupancy 
         o  Construction type 
         o  Height and appropriate means of egress

DEMOLITION APPLICATION REQUIREMENTS

  • Two (2) site plans showing buildings, trees, roads and driveways for lots less than one (1) acre.

                     o Tree protection fence MUST be installed prior to any land disturbance activity.

                     o  If trees will not be impacted (as defined by the City of Atlanta Tree Ordinance), applicant
                         needs t
o submit a signed No Trees Impacted Statement and two photographs.     

  • Detail sheets (provided by the Bureau of Buildings) that will illustrate installation of silt fencing at the perimeter of the land disturbance activity along with construction entrance/exit details and tree protection

                     o  Notation to be placed on the plans by the Bureau of Buildings staff will state:
                        “Silt fencing and construction entrance/exit shall prohibit soil from exiting the site.  This
                         permit is not valid if any existing stream is located on the property.  A
separate plan
                         review and approval is required from Site Development and Arborist.”

  • Seven (7) site plans with erosion control must be submitted for any lot greater than one (1) acre.
  • In some cases an inspection prior to demolition may be necessary.
  • A Sewer Tap Permit is required from the Bureau of Buildings’ Plumbing Division.

CONVERSION (CHANGE OF OCCUPANCY) APPLICATION REQUIREMENTS

INTAKE
The intake process is the stage in which the permit application is created. During this stage all drawings are submitted for review and approval.

PERMIT FEES
A permit fee of $5.00 per $1,000.00 of valuation, or $50.00 whichever is greater, shall be paid. No permit is valid until such fees have been paid to the City of Atlanta and validated by Bureau of Treasury.

  • A re-inspection fee of $50.00 shall be imposed for each re-inspection after the initial inspection when a written notice has been issued requiring the correction of inferior work.
  • All building construction without a permit will be assessed a fee of double the usual permit fee will be charged for. However, in no case shall the penalty portion of said fee exceed $1,000.00.
  • Change of contractor fee shall be $50.00.

In the event additional trips are required to inspect inferior work or installations that have been rejected by the Plumbing Division, a reinspection fee of $50.00 will be imposed for each reinspection after the initial inspection when a written notice has been issued requiring the correction of inferior work.

PLAN REVIEW
The Bureau of Buildings performs plan review services to verify compliance with Building Code, Life Safety Code, and the Georgia Accessibility Code. All plans submitted for issuance of a building permit must be accurate, legible, drawn to standard scale, include dimensions, and meet minimum industry-wide acceptable architectural and engineering standards.  Plans marked "Not Released for Construction,” “Preliminary” and “Permit only” shall not be accepted for review unless otherwise noted for site and foundation permits. 

The City of Atlanta reserves the right to require additional information for plan review analysis.

PERMIT ISSUANCE
Once plans are approved, the permit will be released for issuance by the plan reviewer. The plans are then verified and finalized and paid for at the City of Atlanta, Department of Finance.

Note: Acceptable methods of payment are electronic check, cash, VISA, MasterCard, or certified check.  Business checks will not be accepted.

Each site for which a building permit has been issued is required to be posted with a sign within 24 hours in a conspicuous location and remain posted for 30 days. The sign shall have a copy of the permit, and shall not be less than six square feet, with the words “NOTICE OF ISSUANCE OF BUILDING PERMIT” in letters not less than four inches high.
 
A notarized affidavit must be filed with the Clerk of Council certifying under penalty of perjury the date on which the required sign was posted. (This posting is not required for repairs and alterations that do not increase square footage).

CERTIFICATES OF OCCUPANCY
Certificates of Occupancy are issued by the Bureau of Buildings once all final inspections have been successfully completed and all construction has concluded.  Only under extenuating circumstances will Temporary Certificates of Occupancy be issued for a provisional time period.

Zoning requirements are governed by the City of Atlanta Zoning Ordinance. The requirements addressed in the zoning ordinance include:

  • Setback requirements
  • Permitted uses
  • Density
  • Height
  • Off street parking
  • Sign permit requirements

There are also additional requirements for Special Use Permits, Special Administrative Permits, Variances, Special Exceptions, and Certificate of Appropriateness.  Please contact the Bureau of Planning for information.
 
Special Use Permits are used in connection with land uses identified within particular zoning classifications that are of substantial significance or of unusual operational characteristics.  City Council approves Special Use Permits after public notifications, hearings, and recommendations by the Zoning Review Board.  The processing, review, and decision-making time for Special Use Permits are a minimum of 90 days.
 
Special Administrative Permits are used where complex or unusual technical determinations are involved and/or in conjunction with temporary uses and structures when the matter does not require public notifications and hearings.  Special Administrative Permits are approved by the Bureau of Planning.  The processing, review, and decision-making time for Special Administrative Permits are a maximum of 30 days.
 
Variances or Special Exceptions are used in conjunction with construction proposals where consideration of effects on the surrounding property is of principal importance, and include, but are not limited t building additions that involve yard set-back reductions, construction of fences and walls, and reductions in required parking.  Variances or Special Exceptions are decided by the Board of Zoning Adjustment after public notification and hearing.  The processing time for Variances and Special Exceptions is a minimum of approximately eight (8) weeks. 

Historic Preservation matters are subject to approval by the Urban Design Commission which approves Certificates of Appropriateness.

SITE DEVELOPMENT 404.330.6081
The Site Development division of the Department of Watershed Management reviews proposed construction plans for civil engineering related issues.  Site Development internally conducts standard site plan review.  Primary points of focus for Site Development are:

  • grading and drainage,
  • storm water management,
  • connections to sanitary sewer, stream bank buffers, and flood plains; and
  • erosion and sediment control. 

Note: Standard plan review fees apply.    

Additional Site Development Information

  • The Atlanta City Code and the Official Code of Georgia requires that a fee of $40/disturbed acre be paid to the City; and an additional $40/disturbed acre be paid to the Georgia Environmental Protection Division.   All Site Development fees are payable at the time of issuance of a building permit.  
  • Sites larger than 1.1 acres of disturbed area, or within 200 ft. of State waters may require additional approval by the Georgia Soil and Water Conservation Commission District (GSWCD). The GSWCD staff reviews plans and makes recommendations to the District Board which meets twice a month.
  • An additional 1-6 weeks may be added to the City’s review process should a permit need review by the GSWCD.  The District Board may require sites with unusual conditions to make a formal presentation to the Board. Example: encroachments into 25 ft. state Waters Buffers
  • Work within the 75-foot streambank of any stream within the City of Atlanta must comply with the City of Atlanta Code of Ordinance requirements for work within Streambank Buffers. (Section 74-300 et seq)
  • Review by the Streambank Buffer Technical Panel and fulfillment of the Public Notice requirements may increase the permit process review time by an additional eight (8) or more weeks.

ARBORIST DIVISION
