Zoning Verification

Interested parties can request official documentation of the zoning on a subject parcel through the following processes. If it is determined by the Office of Zoning & Development the current property is non-conforming, applicants will be directed to the non-conforming zoning verification process listed below.

ZONING VERIFICATION LETTER

A Zoning Verification Letter is official documentation of a property’s current zoning classification issued by the City of Atlanta’s Department of City Planning - Office of Zoning & Development. The letter content will vary depending on the availability of zoning records for the specific property and represents the status of the subject property as of the date the letter is issued. Any subsequent changes to the property, or changes that occurred with no record contained in the city’s file, are not reflected.

What is included:

A verification letter will verify the zone district where the subject property is located.

  • Confirmation of address
  • Confirmed zoning district
  • Any applicable overlay zone, planned development, historic, landmark or special public interest district (e.g., Beltline)
  • Existence of an approved or recorded regulatory plan and/or any applicable conditions with corresponding ordinances

A zoning verification letter will NOT include:

  • Confirmation of ROW widening, utility or other easements; building permits or certificates of occupancy; building or fire code violations
  • Validation of property dimensions of subject parcel(s), property line location, or total land area of subject parcel(s).
  • Copies of all approved permits (customer should pursue an Open Records Request

To obtain a verification letter:

Request the verification letter for the subject property by using the Request for Zoning Verification Letter application and submitting payment. If you do not have an address or tax identification number of the location you are requesting, please attach a boundary survey or plat of the property. A request for a zoning verification is normally completed within seven (7) to ten (10) business days after application is deemed complete and payment is received. However, some requests will require longer research and may not be completed within this timeframe. If that is the case, you will be notified of the expected completion date.

Pursuant to ORDINANCE #11-O-1290, a $100 fee will be assessed for each Zoning Verification Letter. If you wish to request letters for multiple properties using the accompanying form, please note fees will be assessed for each property listed on application. The fee(s) must be paid at the time of the submittal of the request to the Office of Zoning & Development. *NOTE: Payment will no longer be accepted by mail.

  • Upon review, select ‘Continue Application’ to complete online payment.
  • Upon payment, send confirmation email to zoningverification@atlantaga.gov to complete process.

 

NON-CONFORMING ZONING VERIFICATION LETTER

A Non-Conforming Zoning Verification Letter is official documentation verifying a nonconforming use or other related information regarding nonconforming use for a subject property. The process involves the Office of Buildings in conjunction with the Office of Zoning & Development, both housed within the City of Atlanta’s Department of City Planning.

What is a non-conforming use?                                                                          

A land use that does not comply with the currently assigned zoning classification. Refer to CHAPTER 24. – NONCONFORMITIES for more details.

To obtain a non-conforming zoning verification letter:

Request the verification letter for the subject property by using the Request for Non-Conforming Zoning Verification application, submitting required documentation and making payment. Requests are normally completed within 10-15 business days after application is deemed complete and payment is received. Once application is processed, an inspection of the subject property will be scheduled by the Office of Buildings – Zoning Enforcement Division within 5 business days. Please note: some requests will require longer research and may not be completed within this timeframe. If that is the case, you will be notified of the expected completion date.

Required Documentation:

Three (3) affidavits, signed and notarized, from persons having personal knowledge of the subject property. Affidavits must contain reference to specific time periods and at least one of the three affidavits must attempt to date back to 1954, as far back as possible or as indicated by staff.   • Affidavits should include the following points of information
    • Location of property in question
    • Time period which is being attested
    • How personal knowledge was acquired
    • Description of the non-conformity as it existed during the prescribed time period
  • Affidavits should document:
    • The non-conformity has been in continuous existence/operation since 1954
    • It has not been vacant for 12 consecutive months
    • The degree of non-conformity has not been increased, reduced or it has not been destroyed by 60% of its replacement value
